These Terms of Service (“Terms”) govern your access to and use of the Delta Supply Co. online store, including purchases made through our website.

Delta Supply Co. is the official online store of Delta Prep Academy. References in these Terms to “Delta Supply Co.,” “Delta Prep Academy,” “DELTA,” “we,” “us,” or “our” refer to Delta Prep Academy operating the Delta Supply Co. store.

By accessing our website, browsing our products, or placing an order, you agree to these Terms and the policies referenced in them, including our Return & Refund Policy, Shipping & Local Pickup Policy, and Privacy Policy.

If you do not agree with these Terms, please do not use the website or place an order.

1. Eligibility and Online Store Use

You may use our website and online store only for lawful purposes.

If you are under the age of majority in your place of residence, you may use the store only with the involvement and permission of a parent or legal guardian.

By using this website, you agree not to:

• Use the website for fraudulent, deceptive, or unlawful activity
• Submit false, inaccurate, or misleading information
• Attempt to interfere with the operation, security, or functionality of the website
• Attempt to gain unauthorized access to the website or related systems
• Upload or transmit viruses, malware, harmful code, or other disruptive material
• Copy, misuse, or commercially exploit our branding, designs, images, or content without authorization
• Use the website in a way that violates the rights of DELTA or another person or organization

We may restrict or terminate access to the store where reasonably necessary to protect our website, customers, business, or legal rights.

2. Products and Merchandise

Delta Supply Co. offers DELTA apparel, PE merchandise, accessories, and other branded products.

We make reasonable efforts to accurately display product information, including:

• Colors
• Designs
• Sizes
• Materials
• Features
• Images
• Measurements
• Descriptions

Actual colors and appearance may vary slightly because of screen settings, device displays, lighting, manufacturing processes, materials, or production batches.

Product measurements and size information are provided as a guide. Customers are responsible for reviewing available sizing information before placing an order.

Minor variations that are normal to the manufacturing or printing process will not necessarily constitute a product defect. This does not affect any rights relating to merchandise that is defective, damaged, incorrect, or otherwise fails to conform to the order or applicable law.

3. Product Availability

Products, designs, colors, and sizes may be available only in limited quantities.

Adding merchandise to your shopping cart does not reserve or guarantee that the merchandise will remain available.

We reserve the right, where reasonably necessary, to:

• Limit quantities available for purchase
• Discontinue products or designs
• Update product specifications
• Remove merchandise from the store
• Limit sales of certain products
• Decline or cancel orders that cannot be fulfilled

If we cancel an order after payment has been collected, any amount due back to the customer will be returned in accordance with applicable law and our store policies.

4. Pricing, Promotions, and Taxes

Prices are displayed in the currency shown on the website.

We may change prices, promotions, discounts, or offers for future purchases at any time.

The price displayed at checkout when an order is submitted will generally apply to that order, except in cases involving an obvious pricing, listing, or technical error.

If a material pricing error is identified before an order is fulfilled, we may contact you to provide the option of purchasing the item at the correct price or cancel the affected item or order.

If payment was already collected for an order that we cancel, the applicable amount will be refunded.

Promotional offers and discount codes may be subject to separate terms, expiration dates, product restrictions, or quantity limits.

Applicable taxes, shipping charges, and other required fees will be displayed at checkout when applicable.

5. Orders and Order Acceptance

Submitting an order represents your request to purchase the merchandise in your cart.

After placing an order, you may receive an email or other confirmation showing that your order has been received. Receipt of an order confirmation does not guarantee that every item will be available or that the order can be fulfilled.

We may decline, limit, or cancel an order for legitimate business or security reasons, including:

• Product or size unavailability
• Incorrect pricing or product information
• Payment authorization problems
• Suspected fraudulent or unauthorized transactions
• Duplicate orders
• Inventory discrepancies
• Shipping restrictions
• Technical errors
• Fulfillment issues

If we cancel all or part of an order after payment has been collected, we will refund the amount applicable to the canceled merchandise and any other amount required by law.

We may contact you using the information provided with your order if additional information is needed to process or fulfill it.

6. Order Cancellations

Eligible orders may be canceled within 1 hour of being placed, subject to the cancellation rules described in our Return & Refund Policy.

Cancellation requests should be submitted as soon as possible and must include the applicable order information.

Once the 1-hour cancellation window has expired, the order may no longer be eligible for cancellation. After that point, the order will be subject to our return, exchange, replacement, and other applicable store policies.

If an eligible order is successfully canceled after payment has been processed, the applicable amount will be refunded to the original payment method.

When the Cancellation Rules Apply

The cancellation rules that are in effect at the time an order is placed will govern that order.

The current 1-hour cancellation rule applies only to items purchased after the cancellation rules were activated or most recently updated on our store.

Orders placed before those rules became effective remain subject to the cancellation terms, if any, that applied when the order was placed.

Future changes to our cancellation rules will apply prospectively and will not retroactively change the cancellation terms that applied to previously placed orders.

Nothing in this section limits any cancellation or refund right required by applicable law.

7. Customer Information

You agree to provide current, complete, and accurate information when making a purchase, including your:

• Name
• Billing information
• Shipping information
• Email address
• Other information reasonably required to process your order

You are responsible for reviewing your information before submitting an order.

If you discover an error after placing an order, please contact us as soon as possible.

We cannot guarantee that order or shipping information can be changed after fulfillment has begun.

8. Payment

By submitting payment information, you represent that:

• The information provided is accurate
• You are authorized to use the selected payment method
• You authorize the applicable payment provider to process the transaction

Payments may be processed through Shopify or other authorized third-party payment providers.

A bank, card issuer, payment processor, or other payment provider may separately decline or delay a transaction.

While DELTA is not responsible for the independent operation of a customer's financial institution or payment provider, nothing in this section limits our responsibility for refunds, corrections, or other remedies that we are legally required to provide.

9. Returns, Exchanges, and Replacements

Returns, size exchanges, replacements, defective merchandise, incorrect items, and product-quality concerns are governed by our Return & Refund Policy, which forms part of these Terms.

14-Day Return Window

Eligible merchandise may be returned or exchanged within 14 days from the date the merchandise is delivered.

For orders collected through Local Pickup at Delta Prep Academy, the 14-day period begins on the date the merchandise is collected.

Merchandise must satisfy the condition and eligibility requirements described in our Return & Refund Policy.

Requests made after the 14-day return window may not be accepted unless another remedy is available or required under applicable law.

Free Return Shipping

Return shipping is free for eligible returns and exchanges that meet the requirements of our Return & Refund Policy.

Customers should contact us and follow the provided return instructions before sending merchandise back.

When applicable, we will provide return instructions or a prepaid return shipping label.

Free return shipping does not necessarily apply to additional shipping costs caused by incorrect or incomplete information provided by the customer, including costs associated with resending an order to a corrected address.

Refunds

Except where otherwise required by applicable law, Delta Supply Co. does not offer monetary refunds for change of mind, incorrect size selection, personal preference, or similar reasons.

This limitation does not prevent refunds associated with:

• An eligible order canceled under the 1-hour cancellation policy
• An order canceled by Delta Supply Co.
• Merchandise or orders that qualify for a refund under applicable law
• Another refund specifically authorized under our store policies

Damaged, defective, incorrect, undelivered, or otherwise nonconforming merchandise will be handled in accordance with our Return & Refund Policy and applicable law.

Nothing in these Terms or our Return & Refund Policy is intended to waive or limit consumer rights or remedies that cannot legally be waived.

10. Shipping, Processing, and Delivery

Shipping, processing, local pickup, tracking, and delivery matters are governed by our Shipping & Local Pickup Policy.

Customers are responsible for providing complete and accurate shipping and contact information.

Processing time is separate from shipping transit and delivery time.

Shipping and delivery dates shown on the website are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

• Carrier delays
• Severe weather
• Holidays
• Transportation interruptions
• Service disruptions
• Other unexpected circumstances

However, the use of a third-party shipping carrier does not eliminate any responsibility DELTA may have under applicable law.

If we cannot ship an order within the timeframe promised, or within the timeframe otherwise required by applicable law, we will provide any notice, revised shipping information, cancellation option, consent request, or refund required by applicable law.

11. Local Pickup

Eligible orders may be collected directly from Delta Prep Academy when Local Pickup is available at checkout.

Customers should not attempt to collect an order until they have received confirmation that the order is ready for pickup.

Pickup availability and procedures may vary depending on academy schedules, training sessions, camps, events, holidays, and facility operations.

For purposes of the 14-day return or exchange window, a local pickup order is considered received on the date the merchandise is collected.

Additional local pickup requirements are described in our Shipping & Local Pickup Policy.

12. Lost, Missing, or Incorrectly Addressed Orders

If tracking indicates an unusual delay or an order appears to be lost or undelivered, please contact us so the matter can be reviewed.

If an order cannot be delivered because the customer provided an inaccurate or incomplete shipping address, the customer may be responsible for reasonable additional shipping charges required to resend the merchandise.

This is separate from our policy providing free return shipping for eligible returns and exchanges.

Orders lost, misdelivered, or undelivered for reasons not caused by incorrect customer information will be reviewed with the applicable shipping carrier and handled in accordance with our Shipping & Local Pickup Policy and applicable law.

A carrier's delivery confirmation may be considered when reviewing a missing-package claim but does not automatically prevent us from investigating a reported delivery issue.

13. Damaged, Defective, or Incorrect Merchandise

If merchandise arrives damaged, defective, or different from what was ordered, customers should contact us as soon as possible and provide the information requested in our Return & Refund Policy.

This may include:

• Order number or proof of purchase
• Description of the issue
• Clear photographs of the merchandise or affected area

If merchandise qualifies as damaged, defective, incorrect, or otherwise eligible for a remedy, we will provide an appropriate replacement, refund, or other remedy consistent with our store policies and applicable law.

Approved return shipping for qualifying merchandise will be provided at no cost to the customer.

14. Intellectual Property

Unless otherwise stated, content appearing on the Delta Supply Co. website is owned by, licensed to, or used with permission by Delta Prep Academy.

This may include:

• DELTA names and logos
• Product designs
• Graphics
• Artwork
• Photography
• Written content
• Website materials
• Branding
• Promotional materials

Our content may not be copied, reproduced, modified, distributed, sold, republished, or commercially exploited without prior authorization, except as otherwise permitted by law.

Purchasing DELTA merchandise does not transfer ownership of any DELTA trademark, logo, artwork, design, or other intellectual property appearing on the merchandise.

15. Reviews and Customer-Submitted Content

If our website allows customers to submit reviews, photographs, feedback, comments, or other content, you are responsible for the material you submit.

You agree not to submit content that:

• You do not have the right to share
• Is fraudulent or intentionally misleading
• Infringes another person's intellectual property or privacy rights
• Contains unlawful, abusive, threatening, or harmful material
• Contains malicious code or spam

By voluntarily submitting content for publication through our website, you grant DELTA permission to display and use that content in connection with operating and promoting the store, subject to applicable law and our Privacy Policy.

We may remove submitted content that violates these Terms or applicable law.

Customers should review applicable terms and privacy policies before using third-party websites or services.

18. Website Accuracy and Availability

We make reasonable efforts to keep product information and other website content accurate and current.

Occasional errors may occur involving:

We may correct errors and update website information when identified.

When an error affects an existing customer order, we will address that order in accordance with these Terms, our store policies, and applicable law.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Delta Prep Academy and Delta Supply Co. will not be liable for indirect, incidental, special, or consequential damages arising solely from the use of or inability to use the website or from matters outside our reasonable control.

This limitation does not apply where liability cannot legally be limited or excluded.

Nothing in these Terms excludes or limits liability, warranties, consumer remedies, or other rights to the extent that doing so would be prohibited by applicable law.

21. Privacy

Our collection, use, storage, and handling of personal information are described in our Privacy Policy.

Information may be collected and processed as reasonably necessary to:

• Operate the online store
• Process payments
• Fulfill and deliver orders
• Coordinate local pickup

In particular, the cancellation policy applicable to an order will be the cancellation policy that was active at the time the order was placed.

To the extent permitted by applicable law, these Terms and transactions with Delta Supply Co. will be governed by the laws of the State of California, without regard to conflict-of-law principles.

This provision does not deprive a customer of mandatory consumer protections that apply under federal law or the law of another jurisdiction where those protections cannot legally be waived.

24. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or, where appropriate, separated from these Terms.

The remaining provisions will continue in effect.

25. No Waiver

If DELTA does not immediately enforce a provision of these Terms, that does not mean DELTA has permanently waived the right to enforce that provision later.

Nothing in this section permits the waiver of customer rights or protections that cannot legally be waived.

26. Entire Agreement

These Terms, together with the policies expressly incorporated into them, including our Return & Refund Policy, Shipping & Local Pickup Policy, and Privacy Policy, constitute the terms governing your use of the Delta Supply Co. online store and purchases made through it.

If a specific store policy contains terms that apply more directly to a particular issue, such as a cancellation, return, exchange, local pickup, or shipping matter, that policy will apply to that issue, subject to applicable law.
